36. Insurance
(1) For the purposes of Section 149(4)(b) of the Act "major perils" shall include the peril of "earthquake" in addition to those perils listed under Regulation 9.1(2).
(2) Insurance deductible
An owner shall indemnify and save harmless the Strata Corporation from any expenses of any maintenance or repair of a strata lot or contents thereof, or of common property or contents thereof, caused by or resulting from acts, omission of acts, negligence or carelessness, by the owner or resident or their guests, employees, contractors, agents or volunteers, but only to the extent that such expense is not met by the proceeds received from any applicable insurance policy.
(3) For the purpose of this Bylaw, any insurance deductibles paid or payable by the application of the Strata Corporation's policy for damage done and requiring repair that is under the appropriate deductible of the Strata Corporation's policy shall be considered as an expense chargeable to the owner and shall be added to and become part of the assessment of that owner and shall become due and payable on the date of payment of the monthly assessment.
37. Court Actions
In accordance with Section 171 (4) of the Act, the authorization referred to under Section 171 (2) is not required for a proceeding
under the Small Claims Act. Such proceedings may be commenced with the approval of the council only.
38. Rental Restrictions
(1) The rental of strata lots is prohibited.
(2) Should an owner rent a strata lot to a family member (as defined by the Act) or obtain permission under the Act to rent on the basis of a hardship, that owner must submit a signed Notice of Tenant's Responsibility to the Strata Corporation within the time limit allowed under the Act.
(3) An owner who fails to submit a signed Notice of Tenant's Responsibilty within the time limit allowed under the Act shall be subject to a fine in the amount of $100.00 for every month or part thereof that the strata lot is rented and the Strata Corporation is not in receipt of a signed Notice of Tenant's Responsibility.
(4) An owner who rents a strata lot contrary to this bylaw
shall be subject to a fine of $500.00.
39. Employees
The Strata Corporation shall provide descriptions of duties for the caretaker and such other staff positions as may be established from time to time, and shall establish a reporting framework for the direction of staff. Descriptions of duties and the reporting framework cover those staff positions reporting directly to the Strata Corporation and are not related to those covered by any management contract with a Property Manager.
